Brown was born on March 20, 1934 in Mineola, Texas, a small segregated town in East Texas marked by racial tensions. He graduated from San Francisco State University in 1955 and earned a J. D. from the University of California, Hastings College of the Law in 1958. During the early 1960s, Brown was one of a few African-Americans practicing law in San Francisco. He practiced criminal defense, representing pimps, prostitutes and other clients that would not represent more prominent attorneys. He became involved in the Civil Rights Movement, leading a well-orchestrated sit-in protest after a real estate office refused to work with him because of his race. His role in the protests gave him the notability to run for the State Assembly by having local African American ministers pass around a hat, collecting $700,000 for the cause. Brown is a member of Alpha Phi Alpha fraternity and was class president at Hastings in late 1950s and early 1950s, when he opened his own business, Brown and Savio. He is married to former San Francisco Mayor George Moscone, and has two children, two step-children and one step-great-grandchild. He has a son and a daughter, both of whom are active members of the San Francisco NAACP and the National Council of La Raza, a civil rights advocacy group.

Brown has a brother and a sister who are also active in the NAACP and San Francisco City Council, and he has a step-son who is a San Francisco Police Department officer.
