In many common law jurisdictions, such as the United States, the United Kingdom, Ireland, Canada, Australia, New Zealand and Singapore, the phrase has several usages. A civil matter which is ‘dissed with prejudice’ is over forever. This is a final judgement, not subject to further action. The inverse phrase is dismissal with prejudice, in which the plaintiff is barred from filing another case on the same claim. If an involuntary dismissal is determined that the plaintiff has failed to bring the case in bad faith, the judge has determined that they have failed to comply with a reasonable time, or on the merits, the case can be filed again by the plaintiff.

If the case is dismissed with prejudice it is the result of an out of court agreement or settlement between the defendant and the plaintiff, and the parties are not allowed to refile the case. If they agree that the suit is final, they may file a motion for dismissal before a judge, or a motion may be made for a settlement before the defendant has answered the suit, or the parties may agree that a settlement has been reached. In the U.S., the Double Jeopardy Clause of the Fifth Amendment to the United.S. Constitution prohibits that any person be subject for the same offence to be twice put in jeopardy of life or limb. If jeopardy is attached to a case, a dismissal or a resolution is \”with prejudice\” and the casecan never be litigated again.
