At the request of Holloway’s father, Alabama judge Alan King declared Holloway legally dead in absentia on January 12, 2012. In January 2012, Joran van der Sloot was convicted of the 2010 murder of Stephany Flores Ramírez in Lima, Peru. In December 2007, Aruban prosecutors announced that the case would be closed without charging anyone with a crime. In February 2008, the case was reopened after receiving video footage of Van Der Sloot, under the influence of marijuana, saying that Holloway died on the morning of her disappearance, and that a friend had disposed of her body. In addition to the ground search, divers searched the ocean for Holloway’s body, but her remains were never found. The family also called for a boycott of Aruba, which gained Alabama Governor Bob Riley’s support but failed to gain widespread backing. On Monday, May 1, she was leaving around 1:30 p.m. and was leaving as she was. She was scheduled to fly home from the Caribbean island on May 31, but she failed to appear for her flight. In a car with the three men who were last seen with her, she said that they dropped off Holloway at her hotel and denied knowing what had become of her. In an interview later that year, Van derSloot later denied that what he had said was true, and in an interview said that he had sold Holloway into sexual slavery. He later retracted his comments and said he had been speaking with Holloway in the days before her disappearance. The three men were each arrested three times, but due to lack of evidence, the three suspects were released each time without being charged with a crimes. In April 2006, the men were arrested again and charged with the murder of a Peruvian woman, who was found dead in Lima in May 2010.
